CIME S.r.l. pone grande attenzione affinché le proprie attività e il proprio business siano svolti con integrità e nel rispetto della legge.

Per “Whistleblowing” si intende qualsiasi segnalazione, proveniente dal personale o da terzi (ad esempio Partner, Fornitori, Clienti, Collaboratori ed in generale Stakeholder), circa una condotta avvenuta nel contesto lavorativo o impattante su di esso e riferibile al personale stesso e/o a terzi, inerente ad una violazione di leggi, regolamenti, regole e procedure vigenti nella Società.

Al fine di rafforzare l’impegno allo svolgimento della propria attività con la massima integrità ed onestà, la Società si è adeguata alla normativa in tema di Whistleblowing, mettendo a disposizione dei propri Stakeholder un sistema di segnalazione che consente di effettuare le segnalazioni come sopra individuate nel massimo rispetto della riservatezza del segnalante, in ossequio a quanto previsto dal D.lgs. 10 marzo 2023, n. 24 (“Attuazione della direttiva UE 2019/1937 del Parlamento Europeo e del Consiglio riguardante la protezione delle persone che segnalano violazioni del diritto dell’Unione e recante disposizioni riguardanti la protezione delle persone che segnalano violazioni delle disposizioni normative nazionali”).

Le segnalazioni possono riguardare informazioni apprese nell’ambito del contesto lavorativo di violazioni potenziali o effettive, ovvero di condotte volte a occultare le violazioni, di:

i) illeciti amministrativi, contabili, civili e penali che ledono gli interessi, il decoro e l’integrità dell’ente;

ii) condotte illecite rilevanti ai sensi del D.Lgs. 231/2001 o violazioni del Modello 231, delle procedure interne rilevanti ai fini del Modello 231 e del Codice Etico, ove esistenti;

iii) illeciti che rientrano nell’ambito di applicazione della normativa comunitaria relativa ai settori degli appalti pubblici, servizi, prodotti e mercati finanziari, prevenzione del riciclaggio e del finanziamento del terrorismo, sicurezza e conformità dei prodotti, sicurezza dei trasporti, tutela dell’ambiente, radioprotezione e sicurezza nucleare, sicurezza degli alimenti e dei mangimi e salute e benessere degli animali, salute pubblica, protezione dei consumatori e tutela dei dati personali, sicurezza delle reti e dei sistemi informativi;

iv) atti od omissioni che ledono gli interessi finanziari dell’Unione Europea;

v) atti od omissioni riguardanti il mercato interno.

Non costituiscono segnalazioni whistleblowing, invece, le contestazioni, rivendicazioni o richieste legate ad un interesse di carattere personale del segnalante che attengono esclusivamente al proprio rapporto individuale di lavoro, ovvero inerenti al proprio rapporto con le figure gerarchicamente sovraordinate e le comunicazioni o i reclami relativi ad attività di natura commerciale o di servizi verso l’esterno.

La segnalazione deve essere effettuata in buona fede e deve essere completa di tutti gli elementi a conoscenza del segnalante, in modo da permettere le dovute verifiche sulla fondatezza dei fatti oggetto di segnalazione.

La Società garantirà la riservatezza del segnalante, qualunque sia la modalità di segnalazione scelta, e gestirà tutte le informazioni in modo confidenziale e nel rispetto della normativa vigente.

La Società, in ossequio a quanto previsto nelle Linee guida in materia di Whistleblowing adottate e pubblicate in bacheca aziendale, ha istituito un “Comitato Segnalazioni” composto dal Responsabile delle Risorse Umane e dal Responsabile Amministrativo, formalmente autorizzati al trattamento di dati personali potenzialmente contenuti all’interno delle segnalazioni ai sensi del Regolamento (UE) 2016/679 (c.d. “GDPR”), e ha messo a disposizione un Modello per la segnalazione, parimenti reso pubblico in bacheca.

Le segnalazioni di comportamenti illegittimi come sopra identificati potranno essere effettuate da chiunque, dipendenti e soggetti terzi, in buona fede e senza paura di ritorsioni, con le seguenti modalità e canali:

–              in forma scritta, sia con la compilazione del Modello per la segnalazione che potrà essere inviato a mezzo posta, con indicazione “riservata personale” al “Comitato Segnalazioni”, presso CIME S.r.l., Via Longarone, 41, 20080 Zibido San Giacomo (MI), sia attraverso l’utilizzo di strumenti informatici, inviando con mail all’indirizzo mail di seguito indicato whistleblowing@cimeitalia.com il Modello per la segnalazione compilato;

–              su richiesta specifica del segnalante, mediante incontri diretti con il Comitato Segnalazioni.

Per fissare un appuntamento con il Comitato Segnalazioni o ricevere la documentazione inerente tra cui Linee guida e Modello per la segnalazione, si può anche contattare il Comitato Segnalazioni direttamente in azienda o a mezzo indirizzo mail whistleblowing@cimeitalia.com.

CIME S.r.l.  takes great care to ensure that its activities and business are conducted with integrity and in compliance with the law.

“Whistleblowing” means any report made by employees or third parties (e.g. partners, suppliers, customers, collaborators and stakeholders in general) on conduct occurring in the work context or affecting it, which relates to employees and/or third parties and which involves a violation of laws, regulations, rules and procedures in force in the Company.

In order to reinforce its commitment to conduct its business with the utmost integrity and honesty, the Company has complied with the regulations on whistleblowing and has made available to its stakeholders a reporting system that allows them to make the above-mentioned reports, with the utmost respect for the confidentiality of the reporter, in accordance with the provisions of Legislative Decree no. 24 dated 10 March 2023 (“Implementation of EU Directive 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law and on the protection of persons who report breaches of national laws”).

Reports may relate to information obtained in the course of work concerning potential or actual violations, or conduct designed to conceal violations, of any of the following

(i) administrative, accounting, civil and criminal offences prejudicial to the interests, propriety and integrity of the Company;

  1. ii) unlawful conduct within the meaning of Legislative Decree 231/2001 or violations of the 231 Model, the internal procedures relevant to the 231 Model and the Code of Ethics, where they exist;

iii) offences falling within the scope of application of Community legislation relating to public procurement, services, products and financial markets, the prevention of money laundering and terrorist financing, product safety and conformity, transport safety, environmental protection, radiation and nuclear safety, food and feed safety and animal health and welfare, public health, consumer protection and the protection of personal data, and the security of networks and information systems;

(iv) acts or omissions affecting the financial interests of the European Union;

(v) acts or omissions affecting the internal market.

On the other hand, whistleblowing reports do not include disputes, claims or requests relating to a personal interest of the whistleblower, which relate exclusively to his or her individual employment relationship or to his or her relationship with superior figures, or communications or complaints relating to activities of a commercial or service nature to the outside world.

The report must be made in good faith and must be complete, including all elements known to the reporting party, in order to allow a proper verification of the validity of the reported facts.

The Company will guarantee the confidentiality of the whistleblower, regardless of the reporting method chosen, and will treat all information confidentially and in accordance with applicable regulations.

In accordance with the provisions of the Whistleblowing Policy adopted and published on the Company’s notice board, the Company has established a “Whistleblowing Committee”, consisting  of the Human Resources Manager and a trusted lawyer, which is formally authorised to process personal data that may be included in the reports in accordance with EU Regulation 2016/679 (the so-called “GDPR”), and has provided a whistleblowing model, which is also published on the notice board.

Reports of unlawful conduct as described above can be made by anyone, employees and third parties, in good faith and without fear of retaliation, using the following methods and channels:

– in writing, either by filling in the reporting form, which can be sent by post, marked “Personal Confidentiality”, to the “Reporting Committee”, for the attention of the Chairman of the Reporting Committee, at CIME S.r.l., Via Longarone, 41, 20080 Zibido San Giacomo (MI), or by using IT tools, by sending the completed reporting form by e-mail to the following address: whistleblowing@cimeitalia.com;

– at the specific request of the reporter, through direct meetings with the Reporting Committee.
